Jermon R. Clark I am a 24 year old, and I've been incarcerated for nine years and nine months. I was initially charged with a state crime in the state of Texas, namely capital murder and grand theft auto. At the age of 15, the youngest of three co-defendants, I really did not understand any type of law. The state dropped the charges so that the federal court could charge me with a new federal law that came out a year earlier, namely the anti-car theft law of 1992. At that time my state lawyer informed me that he could no longer represent me as a federal lawyer because he is inexperienced at practicing federal law. When arraigned by the federal authorities I received another court ordered attorney, who later resigned from my case. Guess who came back? My state lawyer.
I went through a juvenile hearing to see if I was fit to be tried as an adult, which they decided I was without investigating my prior juvenile records that they must do by law (18 U.S.C. 5032) prior juvenile records.
After me becoming somewhat knowledgeable about law trying to fight for my life I obtained years of records that would have been beneficial on my behalf. They, the court, found it appropriate to try me as an adult. My attorney said it was in my best interest to plead guilty so that I could receive another sentence instead of life without the possibility of parole.
Me being young without any financial backing from anybody I did exactly what he asked because to be honest I was scared of something I didn't know anything about. I have filed a 2255 motion and it was finally denied at the Supreme Court level. I have a 2241 motion that I personally drew up and I'm waiting for somebody, anybody to help me. I hope someone with compassion in their heart will reach out to me. I am grabbing for any helping hand, This 50, yes 50-year sentence is too much for me to bear. I have been programming trying to accomplish something so that I can go back into society and be productive.
