I need assistance in researching and litigating Jurisdictional (both Territorial and Subject - Matter) and Constitutional claims for post conviction §2241, §2255 Habeas Corpus attacks. My issues are both obvious and reversible. One deals with a State criminal-code statute/indictment being tried in a Federal proceeding; with a Federal sentencing guideline ultimately being attached to this State statute. The other issue entails the omission of required punishment provisions from my indictment. Under this particular statute, there are seven (7) possible pleadings for punishment provisions found in different subsections, of which none where cited or plead to in this matter. These omissions render my indictment defective and raise serious Constitutional violations.
Even though these claims have substantial merit, my attempts at getting the courts to rule on the merits have been hampered by the restrictions set forth in the one year Anti-Terrorism and Effective Death Penalty Act (AEDPA). I need help in getting over this hurdle and having these claims heard on their merits. I would appreciate any guidance or assistance.
